Congress voted against the DREAM Act, but Obama is looking the other way while California tries to preempt federal law.

But in Georgia and Arizona he claims their state laws are preempted by federal law.




This guy thinks he can have it both ways I guess......

The Conservative Supreme Court Majority need to teach Obama a lesson!

I already gave you the case that says your idea that this violates or conflicts with some federal law is wrong: Martinez v. Regents of University of California (2010) 50 Cal.4th 1277; cert den. 6/6/11. In case you don't know what "cert. den." means, it means that your "Conservative Supreme Court Majority" refused to overturn the ruling. (Thanks for the "best answer," though. I appreciate it.)



Your comment when I gave you the case was "Illegal Aliens are not Resident Aliens. They have no basically zero rights. Plyler v. Doe never applied to College but nice try." This shows you do not understand the issue at all. It has absolutely nothing to do with a difference between "illegal aliens" and resident aliens. The point is that federal law does NOT prohibit giving aid to "illegal aliens." What it DOES prohibit is giving aid to people who are not lawfully in the US if such aid is not available to other people who are not state residents. The California law is applicable to anybody who attended a California high school for three years, whether that person is a California resident or not.

The California initiative is within the state's authority -- adn is not contrary to the Constitution. The AZ and GA laws violate the Constitution.



FYI: just because Congress does not pass a law does not mean individual states can't pss the same or similar laws, as long as they conform to the Constitution.

Also -- the Georgia law, at least, could be constitutional. Had the Tea Party bunch downtown (I live in Atlanta) written the law properly, it would be. Unfortunately, they were more interested in pandering to the local bigots on the one had and agricultural interests on the other. And ended up with a mishmash that won't withstand a constitutional challenge.

The dems despatched armies of attorneys to bypass to Alaska to dig up airborne dirt and dust in the course of the in basic terms suitable election. i'm useful they're going to confirm out some sleazy tactic to take care of the Arizona difficulty.

One minute the right is yelling about states rights, the next they don't want the states to do what they see fit....what's the deal? As far as the right continually talking about how the left doesn't pay attention to the Constitution, here you are, not paying attention to the Constitution when it comes to Georgia and Arizona - it's not Federal Law, its the Constitution that ALREADY covers those issues.

I've been hoping California would make housing free to illegals along with food and electricity..then maybe they'd all want to move there and maybe then I'd find a job...but that's just me.....
