The U.S. Constitution requires the sitting VP, or his designate, to tally the Electoral votes. Federal Law does not allow him to not count the Electoral votes. The Democrats, and States that Biden won, would immediately file a lawsuit against Pence that would be reviewed by the U.S. Supreme Court, and they would have the final decision, again.



Also the U.S. Supreme Court could still swear in Joe Biden on January 20th regardless of whether Pence counts the votes or not.
