An employment or security background check have NOTHING to do with one for a firearms possession request. You have a constitutional right to keep and bear arms, meaning such checks are necessarily limited. You have NO right to a job or a security clearance, so those background checks can be as "penetrating" as necessary and economically justified. If someone has a security clearance for a DoD contractor's job, you would certainly HOPE that their previous arrest records would have been at least evaluated. Arrests, however, are not convictions. Only a felony conviction would be relevant for a firearms background check, if you're unfortunate enough to live in a state that has any background check at all...

O.K. good. now we're getting somewhere.

So the problem is not the absence of a background check, but with implementation.



Failed background checks should absolutely prevent somebody from getting a firearm.



Which means there's a need to come down on straw sellers and a need for (you're not going to like this) a national database. So that a failed background check actually means you're not allowed to access a firearm.

They are down playing the failure of law enforcement to do it's job to justify sticking it to people who are not up to no good.

Because it does not matter if the laws they want to pass will actually do anything to stop the next attack, as long as they do SOMETHING to make it harder for law abiding citizens to get a gun. It is not about stopping the shootings, it is about taking gun ownership away from all Americans.
