It is in our constitution that there shall be no discrimination based on sex, race, religion.. etc. etc. Isn't banning gay marriage discriminating against people. I know that everyone is going to bring religion into this anyways but oh well..

Work it out, haters. And try to pay attention in your U.S. Government class. The words are there, and if you're trying to make arguments based on the "complexity" of the political babble, it doesn't work.

I do think it would be unconstitutional. The constitution was created with room for adaption as society changed, but to keep core freedoms. Well, homosexuality, like it or not, is a lifestyle, it isn't criminal or dangerous, and so homosexuals should have the rights everyone else have.



I really don't like the idea about CA where the court overturned the voter's decision and basically re-wrote the law. I'm against what they did. But I do hope that, in a more fair way, same-sex marriages become legal and that no amendments prevent that.

There is no way to remove religion from it, because marraige is a religion based topic, sadly.



Mayby naval captains should start marrying gay people, since they have the right to marry and it isnt religion based.



unfortunatly, the constitution was created at a time when freedoms werent needing to be defined in such detail.



The process the courts are going through right now is needed, to fix the flaw.



Everyone has the right to be married, the laws just need to catch up to todays beleifs of what our freedoms are.



I think we need to make a "stay the hell out of other peoples business unless someone is getting hurt" admendment.



Where the only people who can determine if something can be done are the people involved, as long as no one gets hurt.



It would allow gays to get married, it would allow people to get married to as many people as they want, and it would give rights to people HURT by someone elses actions.



but it will be a long time before the world stops hating people for who they are or want to be.

No, actually, there is nothing in the constitution that says there shall be no "discrimination" based on any of those things.



If there were, I suspect we could have avoided that whole slavery debacle.

Nope. You know what IS against the constitution? Banning private ownership of fire arms, abortion, limiting freedom of speech, limiting freedom of religion, ..like a previous poster said, "read it."



By the way, "gay" is not a "sex". There are two sexes. male and Female.

gee a political official that wants to go against the constitution thats never been done before. i personally would like to see gay marriage available to anyone who wants it. i am strait. I just think that politics are over rated.

I I don't think the constitution covers marriage period. I think it's talking about other things. I think a Civil Union is ok but marriage does imply religion and well........we know how that goes.

However, the 10th amendment does restrict the government to only enumerated powers, and regulating marriage is not one of them.

It is illegal nonetheless to be deprives of rights based on those things.
