Question:
Obama is a natural born citizen no matter what due to Jus Sanguinis. why do we still challenge his birth?
2009-10-06 16:34:59 UTC
do you really think a republican governor from Hawaii would lie to get Obama into office?

also, consider the fact that his mother was an american from Kansas...so techincally, by the USA policy of Jus Sanguinis, Obama would be a natural born citizen through his mother.

consider that Lowell P. Weicker ran in the 80's for the republican ticket (that's probably why no one attacked him) and he was born in paris to two americans...no court ever challenged him. so why is Obama such an issue?

Because it is the trademark of the right wing of this country to hate things without doing any research and to think only about the rights of themselves.

since early nov of last year, the right decried that this is going to be pay back. they promised that Obama would get treated just like Bush. However, they didn't say that meant he would be disliked, distrusted and that they would pounce on the first thing he did wrong. they meant that he would get the same scorn and disdain that Bush was served up for his crimes regardless of what Obama does. therefore, nothing is too far fetched, absurd or just downright stupid for them not to use against him. They still believe that if you repeat a lie enough times it becomes true as this very question highlights.

BTW: they showed their true colors when the right cheered Obama's failure to convince the Olympic committee to select Chicago. Their hatred of the president eclipses their claimed love of country.

ADDED: Google is your friend, type "Obama birth certificate" and you can find sites that have his B.C. posted in high resolution, incuding factcheck.org who actually were allowed to examine it, hold it, photograph it and smell it.

This idea has been broached by some folk who would like to see Ahnold Schwartznegger have a go at the Oval Office. I personally believe that there are quite enough citizens born in the USA for us to choose from to occupy the most powerful office on the planet. now if we could just get them to run for the Presidency---a job where half the country will hate you and where you have a 14% chance of being shot and an 9% chance of being killed...Garfield, Lincoln, McKinley and Kennedy were killed and T. Roosevelt and Reagan were shot...out of 44 presidents, that's a pretty dangerous job, y'know...

Because a natural born citizen is a native citizen (born on US soil) that has two US citizen parents.

Senator John A. Bingham was one of the authors of the Civil Rights Act of 1866, and was known as the father of the 14th Amendment. He said while speaking about the rights of citizens in the U.S. House of Representatives on March 6, 1866 the following:

"[I] find no fault with the introductory clause [S 61 Bill], which is simply declaratory of what is written in the Constitution, that every human being born within the jurisdiction of the United States of parents not owing allegiance to any foreign sovereignty is, in the language of your Constitution itself, a natural born citizen…. . . "

- John Bingham in the United States House on March 9, 1866 (Cong. Globe, 39th, 1st Sess., 1291 (1866))[http://memory.loc.gov/cgi-bin/ampage?collId=llcg&fileName=071/llcg071.db&recNum=332

Note that he said "of parents not owing allegiance to any foreign sovereignty" Obama's father was a Kenyan national and a British subject. He wasn't an immigrant and was never an American citizen. He owed allegiance to a foreign sovereignty.

A more modern cite:

http://commdocs.house.gov/committees/judiciary/hju67306.000/hju67306_0.htm from July 24, 2000.

"The natural-born citizen qualification continues to provide to the political system of the United States a certain level of protection against the influence of foreign nations. In addition to this safeguard, the requirement also secures the ability of the President to make decisions involving domestic and foreign policy that are in the best interests of the United States without an inherent emotional or familial attachment to another nation."

"It is well known that the Founding Fathers were mindful in the extreme of foreign influences, and the dangers therefrom to the Republic. While experience has shown that a native-born Chief Executive is not necessarily immune to foreign influence, the odds are certainly more favorable if the president is an American plain and simple, who has never been, and is not at the time of taking office, anything else."

"James Madison's detailed notes on the proceedings of the Constitutional Convention reveal that the delegates were deeply concerned about foreign influence on the national government, and in particular on the President."

And of course, there is the definition of "natural born citizen" that the Supreme Court uses:

In Perkins v Elg (1939)

http://caselaw.lp.findlaw.com/scripts/getcase.pl?court=US&vol=307&invol=325

"The court below, properly recognizing the existence of an actual controversy with the defendants ... declared Miss Elg 'to be a natural born citizen of the United States' (99 F.2d 414) and we think that the decree should include the Secretary of State as well as the other defendants."

According to the case, Miss Elg was "was born in the United States of Swedish parents then naturalized here" Her parents were naturalized US citizens and she was born on US soil.

Therefore, a natural born citizen is born on US soil to two US citizen parents.

Obama, however, is not.

"In other words, at the time of his birth, Barack Obama Jr. was both a U.S. citizen (by virtue of being born in Hawaii) and a citizen of the United Kingdom and Colonies (or the UKC) by virtue of being born to a father who was a citizen of the UKC."

The majority of the people promulgating this "birther" issue are asking the gullible for donations for what they represent as a serious issue. They are no more relevant to American politics than the Kenyan woman whose husband the Prince needs money to get out of the Kenyan prison please send money and you will profit handsomely when he regains his throne (variant: general rather than prince).

Why do you worry about such a dumb issue? Sorry to be so snarly, both sides bug me.

For one thing no one has seen his birth certificate. No one.

No one asked for Bush's birth certificate, but they did ask for his military records and college transcript, all of which he freely complied with. So why is Obama hiding his alleged birth certificate from the public? Aren't you in the least bit even curious? Why must only Republicans be transparent?

Obama is NOT a "natural born citizen no matter what due to Jus Sanguinis".

According to federal law in place at the time of Obama's birth, if he was born in what is now part of Kenya he is NOT a "natural born citizen."

If Barack Hussein Obama II (“Obama”) was not born in Hawaii, but in Kenya as stated by his grandmother, his half-brother and half-sister, he would be Constitutionally ineligible to be President because he is not a “natural born citizen.”

“According to Obama's Kenyan (paternal) grandmother, as well as his half-brother and half-sister, [Obama] was born in Kenya, not in Hawaii… His grandmother bragged that her grandson is about to be President of the United States and is so proud because she was present DURING HIS BIRTH IN KENYA, in the delivery room. -This, according to several news sites and Pennsylvania attorney Philip J. Berg…”

See http://www.israelenews.com/view.asp?ID=3324

Obama’s mother (Ann Dunham Soetoro) was born in November 29, 1942.

See http://en.wikipedia.org/wiki/Ann_Dunham

Obama was born August 4, 1961.

See http://en.wikipedia.org/wiki/Barack_Obama

According to Title III - Nationality and Naturalization; Chapter I - Nationality at Birth and by Collective Naturalization; Nationals and Citizens of the United States at Birth (Public Law 414; 66 Stat. 163, the “Immigration and Nationality Act” of 1952)…

See http://bulk.resource.org/gao.gov/82-414/00002F05a.pdf

In part:

Sec. 301. (a) The following shall be nationals and citizens of the United States at birth:

(7) a person born outside the geographical limits of the United States and its outlying possessions of parents one of whom is an alien, and the other a citizen of the United States who, prior to the birth of such person, was physically present in the United States or its outlying possessions for a period or periods totaling not less than ten years, at least five of which were after attaining the age of fourteen; Provided, That any periods of honorable service in the Armed Forces of the United States by such citizen parent may be included in computing the physical presence requirements of this paragraph.

End part.

Therefore, if Obama was born in Kenya in order to be a U.S. citizen by birth, his mother would have had to been prior to Barack’s birth “…physically present in the United States or its outlying possessions for a period or periods totaling not less than ten years, at least five of which were after attaining the age of fourteen…”.

Since Obama’s mother was born November 29, 1942, she would have been 14 on November 29, 1956, and adding the remaining 5 years to that (“…at least five of which were after attaining the age of fourteen…”), this time period would have ended on November 29, 1961.

HOWEVER, Obama was born (apparently) on August 4, 1961, which was almost 4 months before the above deadline passed.

Under the U.S. Constitution (Article II, Section 1), it states that “No person except a natural born citizen, or a citizen of the United States, at the time of the adoption of this Constitution, shall be eligible to the office of President…”.

Based on the above, Obama is constitutionally ineligible to be President of the United States because he was born in Kenya.
