What do you think about Pelosi's response when asked about the Constitutionality of Obama Care?

(CNSNews.com) – When CNSNews.com asked House Speaker Nancy Pelosi (D-Calif.) on Thursday where the Constitution authorized Congress to order Americans to buy health insurance--a mandate included in both the House and Senate versions of the health care bill--Pelosi dismissed the question by saying: “Are you serious? Are you serious?”

I don't think that is in line with her oath of office. The answer to the question is that the Constitution does NOT authorize the Congress to force Americans to buy health insurance. This is dereliction, and disloyalty.

The federal government has no authority.



We can opt out of car insurance because we can ride the bus, walk if we wish, or ride with a friend. This health insurance is a life-tax if you will - it's slavery.

I agree with you, the Constitution dose not authorize the Congress to force Americans to anything the government wants them to do. that is an obvious sign of abuse of power and a sign of corruption, the White House, House, and Senate are full of radicals literally destroying the Constitution and rewriting history to their favor

Well, technically, Congress isn't going to be forcing anyone to buy health insurance. However, anyone who fails to do so will be charged a tax (and then be covered by the government plan).



There is no question that Congress has the right to collect taxes, and there is no question that Congress has the right to establish an insurance plan. Therefore, they are not violating the constitution.

Pelosi's entire life is one big unconstitutional lie.



From what I was reading a month ago on a website of a democratic legal think tank the health insurance reform may not hold up in the supreme court if mandated unless there is a public option. The reason is that no legal precedent exists in a situation like this to force purchase of a private service. I suspect that is why Pelosi won't let the public option die. With a public option they'll say it's legal because you're receiving a government service for your government mandated purchase.

The Constitution does not specifically authorize Congress or governments to do a lot of things.

The Congress shall have Power To lay and collect Taxes, Duties, Imposts and Excises, to pay the Debts and provide for the common Defense and GENERAL WELFARE of the United States"



It's the very first part of the definition of the powers of Congress, which is probably why she couldn't believe that someone asked a question that colossally stupid.

House Speaker Pelosi has an agenda. This is not an agenda that is aligned with her constituants. Her approval rating in California is at a record low of 34%. It is much lower nationally I'm quite sure. How dare she question our right to question her!!!

Why should the tax payers pay for your health.

You should be required to have health insurance & if you cannot afford it

(for various reasons depending on the individual).....then that is the point of healthcare reform.

I think many things are done by the government every day that are not in the Constitution. For instance, we are forced to buy auto insurance. We are forced to go to school a certain number of years. We are forced to stop at red lights. Surely you don't believe that everything our government does is authorized by the Constitution?

taxes are mandatory, otherwise we would have no government because if given a choice, who is really going to pay? Mostly, it will be the people who have no assets, so they don't need to worry themselves with protecting their assets. People can't opt out of illness and injury, so they can't opt out of paying something toward their health care. It makes sense to me.



Oh, and for all the people who want to go without insurance and pay cash, most do NOT have enough cash to pay for that unexpected hospital stay or serious illness, as evidenced by the fact that many people can't even pay their mortgages. and if they can't pay that $2000 mortgage, there is no way they have the cash for that $100,000 hospital bill. As long as the government is forced to pick up hospital tabs for the uninsured who can't or won't pay, we must have a system in which all contribute.
